Service Agreement

This agreement is made between Elegant Lead Pro and the "Client" and is effective upon execution or commencement of services whichever occurs first.  

Product

This Statement of Work covers the following activities and deliverables. 

FULL ACCESS TO ELEGANT LEAD PRO DIGITAL PLATFORM & ALL ASSETS

 

Privacy & Confidentiality

We respect your privacy and must insist that you respect the privacy of fellow Program participants. 

We respect your confidential and proprietary information ideas, plans and trade secrets (collectively, "Confidential Information") and must insist that you respect the same rights of fellow Program participants and of the Company. Thus, you agree: 

  • not to infringe any Program- participants or the Company's copyright, patent, trademark, trade secrets, or other intellectual property rights;

  • that any Confidential Information shared by Program participants or any representative of the Company is confidential and proprietary and belongs solely and exclusively to the Participant who discloses it or the Company;

  • not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions;

  • that all materials and information provided to you by the Company are its confidential and proprietary intellectual property belong solely and exclusively to the Company, and may only be used by you as authorized by the Company;

  • the reproduction, distribution, and sale of these materials by anyone but the Company is strictly prohibited;

  • that if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph the Company and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations from protecting against the harm of such violations.

While you are free to discuss your individual results from our programs and training, you must keep the experiences and statements, oral or written, of all other participants in the strictest of confidence. You further agree that your participation is subject to our Privacy Policy and Terms of Use. 

 

Content

  • Program education and information is intended for a general audience and do not purport to be, nor should it be construed as advice or counseling tailored to any specific business.

  • All materials, procedures, policies, and standards, all manuals, all teaching aids, and the like that have been or will be made available by Elegant Lead Pro or its designated facilitators, or any other source, oral or written, are for individual use in or in conjunction with this training program only.

  • Program content is for individual use only, and may not be sold, tape-recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of Elegant Lead Pro, or its designated agent.

  • The leads and all other content generated by Elegant Lead Pro are Elegant Lead Pro intellectual property.  By canceling your services with Elegant Lead Pro, you agree and fully acknowledge that you will no longer have access to the leads, but you will have access to any branded content images/videos made for your business including any Facebook ads that are in your business manager.

  • Nothing in this agreement shall be construed as a transfer or license of our intellectual property.

  • Nothing in this agreement should be construed as “Work made for Hire” as defined in Section 101 of Title 17 of the Copyright Act of 1976.

  • The information contained in the program material is strictly for educational purposes. Therefore, if you wish to apply (or not apply) the ideas contained in this material, you are taking full responsibility for your actions.

 

Terms of Sale & Cancellation Policy

  • You hereby ratify your understanding that all program sales are non-refundable and waive any rights to charge back your purchase with your credit card processor.

  • Elegant Lead Pro will not do any refunds unless notified at least 7 business days before your next payment is processed.

  • Clients using Elegant Lead Pro may pause the ad campaigns whenever they want and for as long as they want. With that in mind, clients fully acknowledge and understand their payments will not be extended.

  • If for any reason the client would want to cancel services, they must notify Elegant Lead Pro 7 business days before the next payment is due. This cancelation notice must be submitted in writing over email to contact@elegantleadpro.com. In addition, we ask that you schedule and take an exit interview with one of our team members over the phone to help us create a better experience for future partners.

  • This Agreement will be governed by the laws of the State of Minnesota, without giving effect to those principles of conflict of laws that might otherwise require the application of the law of another jurisdiction. You consent to the exercise of personal jurisdiction by any such court with respect to any such proceeding. All Parties waive their right to a jury trial to the full extent.

  • This Agreement constitutes the complete and exclusive agreement between us. It supersedes all prior written and oral statements, conditions, obligations, representations, or warranties.

  • Time is of the essence.

Exclusivity 

Elegant Lead Pro will not offer marketing services for any company within 15 miles that offers the same services as this company. If the client cancels, they lose exclusivity. 

Payment Authorization 

I, the undersigned cardholder, authorize the merchant known as Elegant Lead Pro} to charge my credit card for purchases related to goods and services offered by Company. I agree that my information may be saved by the merchant in a secure payment processor (Stripe) for future payments and understand that this can be revoked at any time with request.
